Prodigious is the number of the cases in which
the name of murder has been stampt upon the act, noxious
or innoxious to person, noxious in some other way
or in no way at all, in a case where no such design
as that of producing death was so much as suspected
to have had place. In an instance whether the
individual should be hanged as for murder, punished
slightly as for manslaughter, or not at all turned upon
the correctness with which somebody's name was spelt.

Never be it out of mind that where a the intention
to produce death has no place not, neither has danger
and alarm from the character of the delinquent, any place,
and that for the exclusion of the inattention in which
the casualty is liable to have its source, either eventual
pecuniary loss is suff will be sufficient, or nothing can
be.
