Art. Can (suppose) this. By habit of body A military functionary
is in a particular degree reposed, and occasionally habituated
to labour be afflicted by a certain disease: others in the
same corps of the same grade, not this an officer
against as towards the man a superior superordinate officer under whose command
he is, bears a known enmity. There being other Officers
by whom with equal probability of advantage to the service the commission
might have been executed, the superordinate pitches upon the
man to be stationed go upon a service be stationed in a
spot known to be in peculiar degree fatal to persons labouring
under that infirmity. The subordinate petitions to
be excused, alledging his infirmity, with such matters of
fact as have concurred in producing in his mind the persuasion
that a residence in the spot in question for the time in question
will be productive of the maleficent fatal effect: and, at
the same time, that, such or such other officers of
qualified for being sent on that same service, not being in
equal de any degree or any rate not being in equal
degree exposed to that same disease, no such change
in any degree, or any rate in equal degree would have
place, if in his stead, some other the commission were given
to some one or other of them. Hearing these allegations
and either not denying the correctness of them, or not opposing
them by any counter allegation of a nature to spor
produce in his mind the determination in the character of reasons
the superordinate persists in sending the subordinate upon
the fatal service, and he is taken sick and dies accordingly.
