Law Amendment or Penal CodePropositions
Without malice against any individual in particular,
evil upon the largest scale is liable to be produced
by a mixture of ignorance and carelessness – of want of
appropriate intellectual aptitude and want of appropriate
moral aptitude – on the part of functionaries possessing
extensive command: in particular those functionaries in
high civil situations to whom it belongs to exercise command
over and give direction to the services functionaries in the highest military situations.
Mortality to an indefinite amount is liable to be produced
by expeditions sent to a a constantly unhealthy spot, or to an ordinarily
healthy spot at an unhealthy time: or what comes to the
same thing, especially at sea, on a course, which at the particular time in question is transcendent in a particular
degree unhealthy, which or on any account dangerous.
For example belonging to this head three expeditions
sent out at three different times by different administrations
may serve: that the imputed misconduct actually had
place is not meant to be here asserted, neither is it necessary
that it should be: that the imputation in question actually
had place is matter of universal notoriety: and
that notoriety is all which for this purpose is required. Those
expeditions are
1. The expedition sent out Aº 17 under Commander
afterwards Lord Anson, to the Pacific Ocean
2. The expedition sent out Aº 18 to the Island Walcheren in
the Netherlands.
3. The expedition sent out Aº 182, to Rangoon in the
Burmese Empire.
