In a case of this description, by one malficent
act produced by a mixture combination of ignorance and carelessness,
lives by thousands and tens of thousands are liable to be
sacrificed. To appoint for delinquency in this shape punishment
as severe is that which is appointed for homicide
in its most maleficent shapes, as above below, would not be
necessary and would scarcely be endured. But sufficient
reason presents itself why in this case a penal suit
under the name of homicide should not be allowed
nor why a pecuniary sufferer in the name of compensation,
a fine mulet as high as in its amount capable of being
raised in such sort as to involve the whole of the offenders
pecuniary means should not be appointed.

Compare the compleat impunity which under the existing
system has place in the a case with the of this sort,
in which the lives sacrificed amount to thousands – ten
thousands with the punishment which under this system has
had place in many an instance in which the loss has
not exceeded that of a single life. While Lincolns Inn
Fields was in the state of fields or in a state not very different
the street way being in a state more or less crowded a boy rides a horse in a gallop, and by a blow from
the horse a passenger is killed. By the vicinity of the
spot to the seat of legal harmony, the wrath it should seem
of learned Judge is kindled: who can say but the case might have that of one of them?: under the name of murder
this act of carelessness or this of blameless misfortune is placed upon a level
with acts of homicide of the most maleficent character,
as above, the boy of course is hanged.
