Law Amendment or Penal CodePropositions
Under a form of government under which the supreme powers
of government are exclusively in the hands of the few, government of course
having for its sole object the prosperity in all shapes of those
same ruling few occasions of this sort calamity in this shape, the fruit of correspondent misconduct can never be other
than probable: Ignorance with Indolence at the same time that Indolence for misconduct, as in other shapes, impunity is matter of well known certainty. Indolence is the necessary
consequence of birth in the lap of opulence: ignorance of ignorance indolence:
indolence coupled with contempt of for the lower order,
and carelessness as to their fate.
In a case of this sort, even want of due attention
and inquiry as to probation should suffice for conviction.
But suppose all power a number of persons, in whose
instance, by reason of their professions and eminence in their
profession unanimous in stating their opinion or assertion
and of the danger, together with facts on which that opinion
has been grounded, the high directing functionary himself not being
by profession or study for forming any adequate judgment
in respect of as to the danger, such evidence might suffice
for conviction: for convicting and for compensation punishment
in the highest degree as above, with or without pu
ulterior punishment in the shape of simple imprisonment, or
other still more afflictive shapes.
