Expositive
Art. 1. In the case of homicide at the moment of the exercise of the maleficent act subject matters of uncertainty
may be the following.
1. The existence of the intention to produce suffering in this shape whether in the shape in which it has place or other.
2. The person on whom the suffering will fall: whether the
individual on whom it has actually fallen, or any one or more, of a number of other persons who by the act are opposed to it.
3. The shape in which the suffering, if any, will have place
that is to say corporal vexation in this shape or in
any other and what shape.

Expositive – Enactve
Art. 2. 1. Subject matter of uncertainty 1. Case the first. Uncertainty as to whether
the existence of an intention was to produce suffering: to wit in this shape
or any other. Examples Cause of suspicion, profit in any
shape to the supposed slayer, expectant on the death of the supposed slayee.

1. Example the first. The supposed slayee engaged by
the supposed slayer to repair to and abide in a spot
notoriously unfavourable dangerous to health and
life in the case of persons in general, or to his knowledge
to the supposed slayee in particular by reason of this or
that particular habit of body. Say
1. A spot in which what is called the plague or some
other disorder, contagious or uncontagious is known
to rage at certain seasons. Constantinople, Alexandria
&c.

2. A spot at all times notorious for unhealthiness: –
Sierra Leone or other places on the Western Coast of Africa.
