Expositive Enactive
Art. 3. II. Subject matter of uncertainty the
second: out of a number of persons all exposed to the
suffering in question, and in respect of whom by analogous
experience it had been assured that by some of
them suffering in this shape would be , uncertainty
whether the slayee would be of the number. Cause of suspicion,
but of suspicion amounting to full assurance, the profit
obtainable by traffic in this shape: by complicity in this shape, in the offence of manstealing.

Art. 4. 1. Example the first. Case of a Negro carried off in
slavery, and in the Ship in which he was carried off,
dying on the way to a this or that part of America, in
the course of what is called the middle passage.

Art. 5. 2. Example the second. By a military Commander
a subordinate sent on an expedition more than ordinarily
dangerous whether in respect of mischief to health, or from the
force of the enemy, subordinates upon the whole notoriously
more apt for the enterprize service being in readiness and capable
of being sent, any of them in his stead. Cause of suspicion;
on the art of the supposed Slayer, enmity declared to the Slayee
enmity, declared by him for example, or otherwise sufficiently ascertained.
