Art. 9. According as the uncertainty has had
for its subject matter one or the other of the above different provisions
will require to be for correspondent reasons requires
to be made.

Art. 10. 1. Case the first. Subject matter of uncertainty
official existence or non-existence of the intention to produce the
suffering, suffering which actually took place or injury
in any other shape – Sole cause of suspicion, profit to the
supposed slayer coupled with the exercise of an some act, by
which contribution is supposed to have been made to the production
of the death in question.

Art. 11. Reason for ranking a result of this sort
under the head of Wrongful Homicide, this: danger, but, in
a case in which the existence of the maleficent effect in consequence
of the supposed maleficent act is to a certain degree
a person who has derived or expected to derive in expectation
of profit from the maleficent effect in any instance should the exercises with
success and impunity the correspondent maleficent
act.

Art. 12. But in this case were the punishment appointed as
ordinary as the punishment of Wrongful Homicide be appointed
for this case, sometimes the one sometimes the other
of two mischiefs would be liable to ensue. 1. Expence on an individual altogether
blameless punishment perpetrated to a crime thus
mischievous might be inflicted: or 2. Under the apprehension
of punishing where there was an offence, an individual
really guilty, might be either left unpursued, or if
pursued acquitted, and thus left, and seen to be by many
understood to be left
in possession of the full profit
of so heinous a crime,
profit to the amount of
which when
in a pecuniary shape
there is no assignable limit.
