Law Amendments or Duelling Extingishable.

Art. Another exemplification of the scantiness
and thence the inadequacy of the state of remedies provided by the
existing system. Supposed prevention or suppression rends
obligation on the alledged Challenge Challenger or other wrongdoer, obligation
to set his terms to an instrument engagement to do
what is called keeping the peace. But to warrant the
compelling him to enter into this engagement, the supposed
Challengee, and upon his oath, declares it to be
his persuasion that his life is in danger: and that
the preservation of his life from the danger is the motive –
is the sole motive by which the application made by him
on this occasion was produced. Now of the transaction
in question an essential feature is – that no such danger
has place. Were it not for the challenge, perhaps it would be
but by the challenge, the option is given to the challengee:
the option whether in the way in question he will expose his life to danger – or
not.

This is among the causes why to a military
man, the use any use made of this security sort of security is so irksome.
