By the praise of bravery what it attaches to the commission
of the crimes to which it is applied it affords a sort of
what would not be afforded by punishment in
any other shape. Witness the popularity of the character
of MacHeath in the Beggars Opera.

It places the criminal for immediately
and for ever out of the reach of observation, and thereby
puts an end to that example which is afforded by a
punishment of the continuous kind.

Of Those who approve disapprove of it in when as applied to the case of
other crimes, there are many who approve of it as applied
to homicide: at any rate in the case where the
word murder is employed in speaking of it. But
of this distinction, the cause may be seen nothing more little
more apposite than the analogy afforded presented by the physical
fact, the identity of the punishment with the maleficent
effect. But in the eye of reason what recommendation
what feature of aptitude on the part of the punishment can
be discerned in its the identity of the suffering produced by it
with the suffering produced by the crime: of identity
in this case the effect should neither be to disapprobation
than approbation.

At the same time on the part of the maintenance
of this opinion there no consistency has place for in the
case of homicide by the consent which is made in the language of the legal tribunals, as in duelling, the same
analogy has place as in the case of murder in the most
atrocious cases in which homicide is murder in the language
of the Public Opinion Tribunal.
