1823. Sept. Constitutional Code. 71.

Positions hereto relating.
1. On the understanding
the torment can not,
in so short a time,
have influence.
2. On the will it has
been constantly effectual.
3. In every instance
in which the refansnancy
has had place,
a violation of the engagment
has had
place, and the engagement,
including an
oath, the violation
has been perjury.

72.

4. {Added.} Subornoers.
those by whom, having it, the hower to
alsogatethe oath and
the falsely declared agreement, the obligation
of taking it has
been continued: they
and their supporters.
&cusable, 13. even justifiable
the fenced her
jurers: notso the voluntary.

73.

Too absurd the supposition
that in every
instance is the torture begins to befelt,
belief groros grew and
strengthened with it.
Conceivable this; not
credible. Frequently,
where torture is not
employed, declared
diversity of opinion
has place: Never where
it is.

74.

7. Useless the torture
where the agreement
would have place
without it:hence, it
should be voted against
by whoever votes for it.

75.

8. According to him, the
effect being a orecessarily
extensive opinion
that perjury is produced
by the torture, it is
therefore worse than
useless.
76. 9. Opinion included
in the opinion that
the notion that the religions
sanction applies
here is true.
The Almighty in constant readings to fulfill
man's vice: as
sheriff judge's. Will it
be said— God has still
the option? howsoever
weakened, the absurdity
is not thus semoreed.
In so far asly man's
will any influence
is exercised over God's,
man's superiority remains.
Only in proportion to
the believed frequency
of this effectuality,
can the religious sanction
here have any effect.

77. 10. Notions capable
of havig place in the
minds, of the above
1. God will not thus
iterfere in any case
2. — or not in this case
3. — or he will inflict
the torments which they
thus preserve in endeavouring
to cause
him to inflict
In this last case, what
malevolence!

78.
Small difference
with which these observations
apply to non-ruling
supporters of
this scene of perjury:
and to all who behold
it without the endeavour
by petition, to
put an end to it.

79.
Indefatiguable in punishing
diselief in
others & uncontradictable
in the confession
of it in themselves —
that punished declared
by direct; that confessed,
by circumstantial
evidence

80.
On the part of jurors,
evil of perjury being
thus unavoidable, remains
for their consideration how
good may be extracted
out of it. Allow for
this purpose, Rule to
jurymen.
