Codification Offer

§. 9. The greatest happiness of the greatest number requires,
that the work, being the work of a single hand and
known to be so, it be known whose that the hand is. Hand,
known whose it is.

1. Unless it be known whose the hand is by whom the Reason. The reasons are manifest. Else, here, as above, neither of the inducements to good
and responsibility, the indispensable workmanship will have place.
of, had no existence, gaving
object it

2. Unless it be Only in so far as it is known who the individual workman is, of whose hand the instrument is the work it not be known
to be
can the work be known to be the work of no more than a single hand. As to knowledge, The truth
is – that, strictly speaking, no such is thing is here possible. In addition to the declared workman's own declaration, all
All that, in relation to the matter can be absolutely known, is –
that by competent authority, a suitable addition by declaration declaration has to this appeal
been made: – a declaration to the effect and appeal to this effect. "This man (naming him) "is the
"man, by whom the instrument has been constructedalone, this draught (naming it) has (we believe) been presented.
But in the case
where the name is
declared, and the case
where it is not declared,
the only difference is
this: that where, by
his name, the person
is declared thenot only responsibility
attention being

the fact of that the work
is the work of no more
than a single hand
may thus be put as
compleatly out of
doubt as it can be doubt as the nature of
and the case and matter of its being, while at the same
time
upon that same
single hand the
responsibility is fixt
by the same operation
fixt:

The only difference, is – that indicative
of a particular in the the
man , the consequence is – that, so large is the
indication , responsibility in
question attached upon him of it applies itself
in proof of the truth of this circumstance, as well
as to the work itself: ,
On the other hand, if the declaration were no
more than this, namely, to this effect – "The work is the work of a
"single hand
", the hand not being named, the circumstance
of the concealment would be apt to operate in
disproof of the fact in question – of the fact thus mysteriously and imperfectly
declared.

Now Suppose now, that, notwithstanding both those declarations,
so it is, that either that the individual whose work the draught
is declared to be had others for his fellow workmen that
he had
not really borne any part of it. Still however,
so far as depends upon responsibility, here is an individual
on whom it attaches, and in its entire state.

This case is brought to view That it may not be thought to have
been overlooked, is this case brought to view, – rather than on account of any considerable such importance
that as seems attached to it. In a case such as the present
no great probability seems to belong to any such supposition
as that of a fraud concocted between two persons, a real misdemeanour
and a falsely pretended one, of whom the real one shall not only be have formed adequate inducements for foregoing
to forego the honour of such a work which is really , and at the same
time being accessory to a solemn falshood and imposture, on which the pretended
for the sake of that same honour, shall have found adequate inducements for exposing
himself to his part of the
dishonour of the
dishonour and falshood and the imposture.
