§. 3. Quasi Jury – Functions.
Art. 1. The Functions of the Quasi Jury are these as follow.
1. Exception excepted Saving the above exception to be in a state of constant
attendance and constant inspection on the s in every cause.
in relation to the proceedings of the Judge.
2. When on any contested point, whether of fact or law
a decision on form is pronounced about to be pronounced by the Judge,
to having contestation between the parties, to have any such
explanation of the question as the Judge my think it of use to
give to them, and a question being put by him to them for them to decide
upon by their answer, to give answer accordingly, or to
decline giving any.
Art. On the occasion of a Protracted Formally contested cause,
when a question of fact is to be decided upon on the ground
of evidence, whether the cause be penal or non-penal ground state of the contestation the question or questions being having by the
Code of Procedure prepared for their cognizance by a
question or questions correspondent to the ground of the demand.
It may serve as a sort of of the sort
of instruction that men receive from Benches, as a proof
of the purposes for which all law when not made by
the people or their removable agent all law has
been and ever will be and must be made: and in
particular that sort of sham law called Common
Law made by Judges in pretence of declaring it
and conceived at by the legislator, becomes instead
afraid and ashamed of being seen to make such
law of and by the .
