which have just been brought to view, the effect tendency therefore is
to cause to be regarded as conveniently conducive favorable to that which
in fact is so conveniently unfavorable detractive from to the end main and
direct end of justice.

Here the functionary on whom on every occasion the
ultimate result of the suit depends – namely the Judge, is
but one: and as to whatever all such functions as are exercised by
those more numerous functionaries his Assisters, they are responsible
each of them for the whatever part he takes it pleases him to take, just as he would be, had he no
Colleagues.
