Constitutional Code
of to for influence
6. Sense of responsibility to the Public Opinion Tribunal nearly
destroyed by the secrecy of their discussions: 7. further weakened
by the magnitude of their number.
6. In the breasts of those ephemeral functionaries Sense of responsibilty to the Public Opinion Tribunal
weakened by the magnitude of their number: 7. still further
by the secrecy of their discussions
6. Magnitude of their number: 7. Secrecy, in which
the part taken by each, and the discussions that have place on each occasion among
them is enveloped.
6. Magnitude of their number: the Of therefore their
effect on every the most trifling species occasions of suit, twelve. Of this
feature the effects may be stated as purely evil. 1. As to the direct
end of the division justice namely rectitude of decision. Toward To the
end< no real contribution is thus made: the decision is determined
not by the real opinions of any of them, but by the
comparative particularity of some one, as evidenced by the superior intensity
of the torture he subjects himself and his comrades to over that
of the greatest torture which any opponent is willing to endure.
True it is, that in the opinion mind of the unreflecting public it
produces an opinion that of the decision thus unanimously
as supposed concurred the rectitude is probabilized rendered probable: probable
in proportion to the magnitude of the number of consentients
which on the other side that of the dissentients is
equal 0. But as Altogether delusive however is that evidence.
Of this feature in the institution through with those
which have just been brought to view, the effect tendency therefore is
to cause to be regarded as conveniently conducive favorable to that which
in fact is so conveniently unfavorable detractive from to the end main and
direct end of justice.
Here the functionary on whom on every occasion the
ultimate result of the suit depends – namely the Judge, is
but one: and as to whatever all such functions as are exercised by
those more numerous functionaries his Assisters, they are responsible
each of them for the whatever part he takes it pleases him to take, just as he would be, had he no
Colleagues.
