Constitutional Code
In so far as and on every occasion in which the laws have for their object the defending
of the people against either those external adversaries or
their internal resistible internal adversaries, and that object
is pursued with effect, their tendency and effect is beneficent:
but in so far as the have for their object the giving
effect to the operation perpetually carried on against them their happiness in the
way of depredation and oppression in other shapes by those those same
irresistible adversaries, that tendency and effect is maleficent:
beneficent therefore is the exercise of any power
by which their force is the effect of their power is exercised applied
is lessened weakened.
Under every form of government In every country the power of the ruler is occupied
in providing the defending defence of themselves and thence unavoidably
of the greatest number people against their common adversaries – the external and irresistible ones. But in a demo
only, only where the people themselves are above their
rulers to certain purpose, and on certain occasions above those
their rulers is any provision made against the depredation
and oppression exercisable and has to be exercised over them and at
their expence by rulers. Under every other form of government
the object of rulers with their laws have for their precise object the
keeping the people in a state as compleatly defenceless as possible
as against those same rulers, while that in the course of depredation
and oppression in all other shapes may be carried on with
greatest effect and least disturbance.
