Constitutional Code. I. Enactive Part
Another consideration is, that on the part of the public community at
large security and the opinion of security in all its shapes
depends not so much immediately on the actual rectitude of the conduct of
the Judge on the occasion of the several suits, as
upon the opinion conception entertained in and by the community in
relation to such rectitude: in so much that of supposing
such a state of things possible it were for much better far better
that the conduct of the Judge should be always wrong and
at the same time yet universally thought right, thence that it
should be always right and yet universally thought wrong, in
so much that the principal if not the only are of its being right
or that the more generally it is right the more generally will
it be thought to be so. Such thus it is that in under the current
systems of judicature, the delusion by that system of delusion
by which in the truth of constant and universal experience
the people at large to a great extent are maintained in the persuasion that
the conduct of the Judge is in general right, the mischief of the
injustice with which the whole course lesson of the proceedings is
so thoroughly impregnated is to a certain degree in as an inconsiderate lessened.
