§. Grounds for Quasi Appeal
§. Grounds for Quasi-Appeal.
Art. 1. A Ground for a Qusi-Appeal is any
act, affirmative or negative on the part of the Judge
below any act, affirmative or negative, the effect of
which is or would be – to place the Quasi-Appellant in the same
situation as if an undue definitive degree in
his disfavour had been issued and executed – or
but for the remedy interposition demanded by at the hands of the Quasi-Appellant
would be.
Art. 2. Referable to To one or other of the following
heads are is every judicial act having the effect of misdecision
referable.
1. Refusal Denial, declared or virtual of means of proof,
to wit either in the aggregate or in the instance of some
one assignable understood and assignable means or
source or article of evidence.
2. Denial, declared or virtual, of some means of executioning or actual or eventual, in possession or in expectancy.
3. Denial, declared or virtual, of means of defence, actual or eventual,
in possession or expectancy.
4. Denial, declared or virtual, of some means of communication
necessary or necessary to the purpose of po obtainment
of some means of proof or of some means of
execution or acquittal or defence in time for the purpose.
5. Undue Delay, whereby the timely obtainment of some means of proof
in appropriate time or of some means of eventual execution actual or eventual
or in a direct way, or by withholding of some means of communication interception of communication
is prevented or unduly retarded.
6. Undue precipitation: whereby the obtainment or use of some
means of proof, execution, or even bycommunication as above, for the purpose of
proof or , or effectual
defence or of some
means of elucidation in
the way of argument is prevented.
