Ch. Appeal and Quasi Qppeal
§. Grounds for Quasi Appeal
Art. 9. For undue precipitation, whereby obtainment means
of proof, means of execution, means of communication, means of elucidation by argument or means
of the acquittal or defence, have or may have been definitively
or temporarily prevented.
Art. 10. Of In each of the above cases is the
the mischief evil from the wrong will of course depend upon its
effect on the issue of the suit. In so far as things can be
placed in on the same footing state as they would have been in on, had
the wrong not been done, to place them in that state with
the appropriate remedy: in so far as this can not be done
compensation at the expence of the wrongdoer of all perhaps
concerned in the doing of the wrong will be the remedy required.
Art. 11. The provision here made supposes that the
relief here allowed to be prayed for was
at the hands of the Appellate Judicatory Judge has in substance
been denied by the Immediate Judicatory Judge.
