§. Grounds for Quasi Appeal Judges Option
§ Option on Quasi Appeal
Art. 1. Option of the Judge Appellate on the receipt of
a Quasi-Appeal are the following as follows.
1. In every case alike, where when the with the Quasi
Appeal being is regarded as groundless or insufficiently not sufficiently grounded
opinative decree. Quasi-Appeal name itnaming it, to wit
Petition for supply of means of proof, for dp of means of execution,
&c., groundless, or not sufficiently grounded.
Terms of Imperative decree addressed to the Judge below. Proceed
to execution, or Proceed to acquittal as the case may be.
Art. 2. If, from what appears on the face of the record, the
Judge Appellate can nature of the case admitts of the Judge is such, that wrong in
one or more of the above shapes having been committed, the Judge
Appellate seeing what can see what is the proper issue
of the suit, he declares as much and decrees accordingly;
giving such imperative decree as might have been given had
the Art. a definitive decree been pronounced by the Immediate
Judicatory in disfavour of the party wronged,
and Appeal made against it in consequence.
Art. 3. If no such conception can be obtained, the
he then declaring as much by his an opinative decree
he by an imperative decree orders a new Quasi-trial
if that can afford a remedy in the same Judicatory or another as seems to him
most apt. the As to a new Quasi Trial before a different
Judicatory see Ch. §.
Art. 4. In any case for all injury in whatever shape
produced by the wrong, he orders compensation, as per §. (the
last preceding Section.
