Constitutional Code or Procedure

Art. 6 For the case where the subject matter of the
Appeal is – not the ultimate decision but some incidental
act act or omission, positive or negative on the part of the
Immediate Judge see the Procedure Code at Appeal.

Art. 7. In a penal suit, if the Appellant being
the Defendant is not in a state of incarceration confinement, he
is at liberty to repair to the Appellate Judicatory, and
make representation for himself in his own person, as
well as in the person of a substitute, professional or
non-professional.

Art. 8. So, If he is in a state of incarceration, on on
giving sufficient security paying the expense of conveyance in custody
that like liberty unless his case be of the number of
those in which, to warrant Appeal the fiat of the a Quasi
Jury is necessary: neither in this case is he transferred
to the Appellate Judicatory unless for such
transference a separate fiat from the Quasi-Jury
be granted.

Art. 9. In a penal suit, if the decision of the Immediate
Judicatory be simply confirmed without modification, an
addition is made to prevent undue delay, and on the part Pursuer's side
of the pursuer groundless vexation and expense an addition is made to the
punishment, as of course, but with the power to the Judge
Appellate to express remitt it in the whole or in part,
for specific cause assigned. The For In regard As to the
quantum of such addition in the several cases provision
will be made in the Code of Procedure. Whatsoever On this occasion, The minimum
of that which will suffice for the prevention of insincere
Appeals will be sufficient is all that will be appointed.
