Constitutional Code Ch. Appellate Judges

Art. 10. If the Appeal be by the Pursuer General for
insufficiency of the punishment, no addition can be to made to the punishment can
not by the Appellate Judicatory be encreased, unless
the Respondent Defendant in the Immediate Judicatory
if such be his demand has had the faculty of argumentation in the Appellate Judicatory in his own person
as well as in that of any Substitute of his professional or
non professional
