1827. Jany. 24. Nov. 22.
Constitutional Code Ch. IX. Ministers Ch. XII Judiciary Collectively
§. 26 Term of Service

Ratiocinative. Exemplificational
Art. 5 In every mixt Monarchy, in the instance
of the great functionaries, the whole of a man's behaviour
is an uninterrupted course of bad the opposite to good behaviour
in it's most pernicious shapes. Of every Judge, so
far as regards the Monarch's sinister interest, the
behaviour is an uninterrupted course of corruption:
corruptor, the Monarch; corruptee, the Judge.
Not only for himself but for all his connections
of all sorts, the Judge has everything to gain by the
favour of the Monarch; much to lose, by the want
of it. The Judge, in his situation, does he want
to be told by what course of conduct the Monarch
is most likely to be pleased?

Ratiocinative
Art. 6. Still Not that the sort of non-dislocability, in the
shape in which it is possessed by him, is not altogether
without its use: by it, limits are set to the
Monarch's power to do evil to him.

Ratiocinative.
Art. 7 By this phrase during good behaviour,
and the confidence reposed in the virtue of it not only in England but in the Anglo-American United States England and the United States
an exemplification is given of two things: the power
which, by long connected associations, words have of
producing delusion: and in the case of the Anglo-American United States the influence exercised over
the understanding of the people of the United States
by the practice of a nation Government from the imperfection of the yoke of whose oppression
they have shaken off. which such sacrifices had been made by the by them to rid themselves.

Ratiocinative.
Art. 8 On the part of public functionaries good
behaviour is on this occasion regarded as a thing of
course. Security entire, and the words during good behaviour the shift of which it is made course. If on those occasions, and on the part of the
functionaries in question, why not on every occasion,
and on the part of functionaries in all departments
and of all ranks. On this supposition these three words pronounced, Absolute Monarchy would on might at
this supposition be this much apt and so small an expence be required the assuredly good of all forms of government, besides requires the least expence
of thought to institute.

Rationcinative. Exemplificational
Art. 9. On the direct contrary supposition, was grounded grounded
the general plan of the constituted of the United States.

In the continual repetition of the phrase during good
behaviour
, all these men are in office during good behaviour
men seem to have fancied they saw a substantial security
for the sort of behaviour in question.
