☞ Addendum 11 Dec. 1825.

Among the cases of this description the most prominent
is that to which all governments are but too
apt to give birth, namely the case of a war Of a
which the state of thing by which in the traces of the greater calamities
is produced the waste and injustice incident
to every mode course of proceeding by which the rights
arisin and obligations arising out of the extra expenditure
can be carried into effect. Considered as occupied in
business of this description a Judicatory may be designated
by the denomination of an Account taking
Judicatory, an Audit Court is the name by which it has been distinguished in English practice.

To the provision made this class of cases English practice has added
a one the demand for which which has f
is not more casual and less extensive. This is
the class composed of the cases in which to her
money or money's worth being on a particular occasion
lodged in large masses in the hands of
the government in the representative of the State, for the
purpose of being distributed among a number of
persons more or less considerable, on in compensation
for example for losses damage sustained by them losses which have fallen up
from whatever source whether delinquency or calamity have fallen upon him on this
or that occasion fallen upon them. A Court of Claims
is the name denomination by which a Judicatory i short English practice constituted for this
purpose has been designated.
