1825. Decr. 11.
Procedure Code? Constitutional Code Omitted out of Located how.
Ch. XII Judiciary Collectively
§. Located how
(4)
So in whatever part of the field a demand may have place
for Judicatures of exception, the cases here in question will not be comprised in it.
for Judicatories Of the demand which presented by the Army Service and Navy Service
present for special judicatories as all of the grounds of it
a statement view may be seen elsewhere has been given already. Of all those grounds
with the exception of that for which applies to the demand for a special locator, not one,
it may be seen, has place in the present case instance.
No content with establishment of Special judicatories
with proceedings enacted in the darkness, and Judges
paid in a manner which gives them an irresistible interest
in the maximization of expence, for the less the dispatch
they give the longer their emolument embraces to be paid.
English practice to this employs for the ascertainment
of the alledged facts in question a an altogether different assemblage
of rules of evidence,⊞ ⊞ demand being allowed
upon the ground of one
single piece of written evidence
called a voucher, for that
statement being evidence subjected
truth of the statement neither
that security being afforded
which is given by subjection
to counter-interrogation
nor so much
as that which is given
by the punishment which
has been attached to the ceremony
of the oath. Not that in this there is anything
in practice as would at first sight be supposed in comparison
with its proceedings in this respect in ordinary cases,⊞
for in English practice nothing is more familiar than in
different judicatories to employ for the under the rules of
coming at the truth of the case mean altogether different: agreeing
in nothing but the amount inapti insufficiency and
and inaptitude.
To an ordinarily constituted mode especiallyy in high situations. the difficulty
of inflicting punishment on a man with whom
one has been in convivial habits is unsurmountable.
