§. 29. Account-taking Judicatories

Instructions to the Legislator

Art. 1. For Account-taking Judicatories it may
happen that special provisions may be found requisite.
Take for example those which following. Such as the following
for example.

Art. 2. By an Account taking Judicatory understand
a sort of Judicatory which has no other employment
than the settling the balance or d say difference due as between one party
and another in consequence of money or moneys worth
received disposed of at divers times in an indefinite number by
each at the desire or otherwise for the benefit of the other, or by each remaining, due to the
other.

Art. 3: This balance The balance The evidence by
which this balance is determined consists commonly of is
is in common exclusively composed of a set of written
documents called vouchers: and in each instance evidence
of this sort is without any oral evidence or
counter interrogation regarded as conclusive evidence of the
matter of fact for the proof of which it is adduced.
Of a judicatory of this sort the ordinary occupation consists
therefore accordingly in the reception given by the Judge to the
vouchers presented by the or on behalf of a party on one
side. On one side of the account are stand the articles which
he admitts that he has received: on the other of which admitts
reception of no other proof it a manifest need to require: on
the other the articles which he alledges he has delivered or
caused to be delivered: and of of delivery the several act
of a delivery or assemblages of acts of delivery the several vouchers
are exhibited as conclusive evidence.
