Constitutional Code Ch. XII Judiciary Collectively
§. 29. Judicatories of account
Art. 4. But, ere an account can be in a
manner conformable to justice, decision on the subject of divers collateral demands applications
may incidentally require to be delivered: Of these collateral
demands each such demand being of a nature to be entitled,
and thereby constituted the matter of a distinguishably
separate suit. Of these demands examples are as follows.
1. Accusation of Application for the disallowance
of a voucher on the ground of its alledged unauthenticity
2. Allegation of a fraud in respect of the non-performance
or malperformance of some service, the proper due performance
of which is attested by the voucher.
3. Application for liberty to exhibit evidence of the performance
of service in some shape or other by one party or the other of some service, for which it having been
alledged by one party to have been rendered by hi to the other
of which it is alledged by one party that it was rendered by him to
the other and no appropriate voucher thereof received as the other but that no voucher for it was received, of that an appropriate
consequence, but that voucher for it having been received
or by some accident lost, in either of which cases
either the value of the service will of course be lost to the
applicant, or, such other evidence in the in proof of its having been performed can happen to afford
must be must be exhibited and received.
