Whatever good forms are co & If the maintenance of liberty be the object
for that purpose there is no comparison between
single Juries and single Judges dependent in
the way mine are upon the body of the people.
Liberty depends upon is in proportion to the influence which the
people have in every department of government.
In this way of what use can Juries be any otherwise
than is in as far as in each case they prove they are a sample
and that a fair one of the whole body of the
people. But if it be good to have a sample,
how much better to have the whole piece. The public is composed of wheat and tares: and the wheat predominates ever so your Jury may be taken all of it from the tares. Of
what use to take so imperfect and inadequate a
representation of the people when you can have
a fair one.
The influence of Juries is subtle, uncertain
unconjectionalbe, futile, broken, discordant: it is the
stabl stability of a house divided against itself:
it is different in different places: you can never
be sure of it two days together. He who is saved
by one jury may be sacrificed by another: under their auspices the hero
of today may be the victim of tomorrow.
