Besides these ill effects the above immediate which arise immediately
out of the particular nature of this institution
others there are which though they spring out scarce less
immediately attached to it of it in a more smooth or indirect maner,
must not be wholly passed over, if we would
wish to make a fair and just estimate of its
claim to the praises that have been so lavishly bestowed
utility upon the whole upon it.

1. Complication is an article that neither on in this
or any other branch of legislation ought ever
to pass unheeded. The beautiful simplicity
which otherwise might characterize shine conspicuous in the system
of procedure is sadly and unavoidably deformed
by this cumbersome appendage. What a mass
of irregular and indigested of regulation on this head does the English code
offer on this head! Yet even this is but a small
evil in comparison of the heap of rubbish
which in the language of English lawyers goes
