is not independence one of the first qualities in such a magistrate? a judge
can there be probity exist without it? And>
here you are destroying it Yes under a despotic
government: and for the same reason one of the
worst under a popular one. Necessity

This is one of such a the multitude of principles notions which are bad
under a good government in proportion as they
were good under a bad one. Under a corrupt bad constitution poisons are remedies: under a sound one they are but poisons. Necessity of Independence in
judges, mischievousness of non-venality in offices, necessity of division of
power, necessity of trials by Jury, all these are among the
vulgar errors for which we owe are indebted to the
despotic system, and which under that system
were not no errors but sound truths. Men
who have been used to no other than a corrupt
system go to work with notions formed under
that system, true as applied to that system, but proportionately false as applied to an opposite one.
