Thus far as such defects as which though
actually interwoven with the substance of the
institution are capable of being extracted from picked out of
it without altering changing its essence. It is a task
much easier and still more evidently necessary
to clear away separate from it and lay aside any circumstances
which though not belonging to this
species of tribunal more than to any other, are
likely in virtue of an accidental connection to
have had an influence in the composition on the opinion generally
entertained of its utility

Compare in an undistinguishing point of view
what is called Trial by Jury with the other modes
of trial which are most likely to be contrasted with
it, it is not only the best mode of trial, but
the only one which deserves the name. What can conclusion
we infer can be drawn from thence in favour of it?
