Juries 3 Innate Defects interest and every malignant passion, range without
controul. In that this privileged and lawless independent precinct
neither the law of the land nor the law of public opinion are
of any force: to the eye of the public and to the eye of the law the sacred darkness of the Jury-room is alike impenetrable.
3 2 in the article of exertion From p. The point of exertion is not less compleatly
abandoned than that of probity: — What habits
of exertion have they acquired? what inducements
do they possess? who will know whether
they exert themselves or no? Who will pay them
for their exertion? who will blame them to whose
censure will they be subjected to by the want of
it?
4 3 in the article of intelligence The point of intelligence is precisely in the
same case. In regard to Judges so called, in
regard to Judges by profession, the question is
about concerning degrees of intelligence, about concerning degrees of superiority
in intelligence. Here all superiority
is out of the question. Here with your eyes
open you take up with the lowest and most
vulgar measure. Special Juries promise something
more: but for the moderate and inconsiderable unascertainable
difference you give up submitt to you purchase at the expence of a particular disadvantage of other points
of which hereafter.(a)
(a) The Aristocratical interests and prejudices, which in a Jury admitt not of that controul to which they are subject in an elective Judge.
