of a Juryman as in the head of a Judge or of a
King, Justice has not a deadlier foe enemy than this
dange insidious and domineering principle. In
the station of a Judge it can have no other gratification
so compleat as is than what it gives itself at the expence
of Justice. In <add>fulfilling following the purposes of the</add> While he executes the law he does but pay
obedience: it is only dispensing <add>by crossing them only</add> in the working of that he can
displays power the plenitude of his power.
In the King and the Judge this principle
is made or might be made to experience sufficient
checks is or might easily be kept in order
acting as they do or might be made to do in every instance in broad day-light by sufficient checks by checks which are or might
be made sufficient. This is not the case, this
never can be the case with the Juryman. In his
breast all sorts of caprices all sorts of can only
passions have full swing: his characteristic property is to act
in the dark: bringing him into the light, you see
h change loses he changes his nature.
If this an of arbitrary power is no imputation to Juries no more
ought it to despots — Despots do not to exercise
it wrong that is in a manner they think
wrong upon the whole.
