3. The point of intelligence is precisely in the
same case. In regard to Judges so called, in regard to Judges by profession, the question is
concerning degrees of intelligence, concerning degrees
of superiority in intelligence. Here all superiority
is out of the question. Here with your
eyes open, you take up with the lowest and
most vulgar measure. Special Juries promise
something more; but, for the moderate and unascertainable
difference can not be had but
at the expence of a particular disadvantage
of which hereafter.
Aristocratical interests and prejudices: which in a Jury admits not of that controul to which they are subject in a responsible and elective Judge.
