The benefit of immediate decision is foregone: Over all Sunday<add>Today</add> a mans
hand writing is confessed to a bill of exchange, or an
assault proved before the a Judge: yet though the
business is fully ripe for judgment the same half
hour, judgment can not be given till this day
sennight, because there is no proper Jury at hand, and
time must be given for getting one together.
The bed of Procrustes is the exact prototype model
of the English Jury box. The natural length of
a cause varies to infinity: from less than five
minutes to more than twice as many years.
How can it be otherwise? were it only for this single one only to consider
consideration cause that the examination of
one witness may unexpectedly indicate the simplicity
of another, and that witnesses or their own
depositions may have to be fetched
from the antipodes. Happily such peremptory
calls for delay are not fore comparatively frequent.
The causes where natural duration is but momentary
are, beyond a in the proportion of ten to one,
at least, the most numerous: they would be greatly
more so if justice were not rendered under an article
of contraband to the bulk of the community by prohibitory
taxes, and added to a system of procedure which
produces the mischief of taxation without the use.
To objects scenes of such different dimensions what is the treatment
given by the English Jury-system? Causes of five
minutes it stretches to six or to twelve months: causes of as
many years it maims and cuts down till, after a space
of six or twelve months unemploy'd it reduces them to the margins of
