The unanimity, though perhaps an invariable
and certainly a very close concomitant accompaniment to the instruction
that unanimity, the instrument so much the feature so fondly dwelt upon and
analyzed idolized is happily not altogether an essential
one. When I say unanimity the unison of
minds, it is in compliance with the impropriety
of language: univocality, the union of views, if
there were such an expression, would be the proper
Now something may be said of the means by
which and by which only such
a sort of union could be insured.
. It is the sort of unanimity which tyrants
vouchsafe to be content with, and which none but
tyrants would they allow themselves to reflect,
would content themselves with: it is the unanimity
which in the Church is produced by forced creeds
and subscriptions, and tests and penal lawspersecuting laws.
I speak here only of Juries for trial: as for sort
of Juries used for previous inquiry, under the name
of Grand-Juries, they will be considered separately.
