2. Another of is that of the vicinity of the abode
of the Judges to the dwelling of the parties. This circumstance
is sometimes dwelt upon as a wonderful
advantage. But the principle thus magnified has been
gradually departed from in practice, and with great
reason. Vicinity induces a chance of acquaintance,
a certain sort of knowledge <add>a certain sort of knowledge of character</add>
but for that very reason but in exactly the same proportion it induces a
chance of partiality. This partiality is the
very thing of all others that ought to be avoided, from
whatever source it flow: and the of the knowledge
from whence it is so liable to originate come, as much
as is useful to be had in better towns by other
means. The knowledge which it is hoped the
persons in question may desire from their vicinity,
the knowledge of persons , facts and characters is
the very reason upon the supposition of its existence
a reason why they should be witnesses: and a reason equally conclusive
the very reason why they should not be Judges.
