<p>4. A furter fourth alledged advantage nearly connected
with the one last mentioned, is the use of Juries
in taking easing the Judge of a part of that
load of unpopularity which might be liable in
certain cases to bear on him without his deserts.

4. Saving the establishment from the misfortune of
unpopularity.

1. This advantage, suffer such as it is, and
supposing the fact to be as it supposes depends
upon those properties which have been shewn to be
attended inseparably connected with inconveniences of a much stronger
texture: impermanency,unaccountableness, inexperience.
unaccountableness, and thence improbity;
impermanency and thence inexperience.

2. It is besides confined on several accounts to
the present state of things in England: it disappears
when applied to the so much better state
of things to which is things are affairsso rapidly advancing in France.
It disappears in particular when Juries are compared the comparison
is made with the sort of Judge that results from
the provisions above proposed. In England, under
the present state of the law a Judge may have
contracted a very large measure of unpopularity
