As to real difficulty Judges a judge
might experience in the discharge of such a function
it is not likely that Juries should experience less.
That which is difficult to superior intelligence talent is not
likely to be much less difficult to inferior: a an
increased exercise of discretion decision which it may be difficult for one man
to come to settle with by himself, is not likely to be
much less difficult for twelve men to settle one
with another amongst one another. The dark darkness reginence
discipline of the Jury-room hides covers it is
true all incapacity and all difficulty: but to
cover hide an imperfection hiding a mischief is not removing it: is not to remove it: to cut
cutting the Gordian a knot is not to untie untying it.
