The question it is to be remembered is all this
while between a Judge with a Jury and a Judge
without one. But if you have got a sort of Judge
to your mind, secured in the possession of all the
qualities that can be wished for that can be necessary
to the due discharge of the duties of his office, it
is superfluous to think of adding twelve more, were
their possession of the same qualities as sure as
it has been shewn to be precarious, and were the mode in which they must be confined to art as
favourable to the purposes of justice as it has been
shewn to be the reverse. The question is not between
a Jury and an unaccountable Judge:
but betwixt twelve men unaccountable men as a Juryman
always must be, and an one one man strictly
and perfectly accountable.
