But suppose the decision of a Judge liable
to be now and then unpopular, on whatever question given or
any question whatsoever: whether the question of
the fact; or on in respect the question of the mode starn and quantum of satisfaction
summary or of any other kind, or on
the question of the mode and quantum of punishment:
what is the natural and proper way of
making use of this species of tribunal supposing
it to be a mere popular one? more likely to be acceptable to the people? Clearly to make
use of it in the cases were it turns out to be in
that predicament: in those and no other: to application
of this expensive remedy is then confined
to the cases where it is called for by the
appearance of the disease. As an ingredient
in the standing regimen of the body politic, it
has been shown to be unsalutary on a multitude
of accounts unsalutary in a very high degree:
as an extraordinary and occasional and extraordinary
remedy it may have its use. This accordingly
is the one which in France I propose to
make of it. If the people like it I give it them they may have
