Of all these debelitatives relaxants in the legal materia
medica of time there is not scarce one that is not uniformly
and exclusively favourable to delinquency: that is
their effect, and that is their sole use. In innocence
they are of none: for it has neither any
interest to avail itself of them nor the power,
without forfeiture forfeiting <add>surrender</add> of character and calling for condemnation
at the bar of public opinion.

What is the consequence of this pretended
lenity? Next what is wanting to punishment
in point of certainty must be made up, and
very badly made up it is, in point - by
magnitude: so that instead of the certainty of a
mild and apposite punishment which would put
a stop to the offence you get an exorbitant and
inapposite one, which leaves its own mischief
and that of the offence running on together.
