common current notions of the time selected with judgment,
and display'd to the best advantage.
Indifferency is the sole foundation of the on
which he builds the supposed superior excellence
of the Jury judicature. W How To what degree that foundation
fails we have seen already: But this is
not every thing that may be collected from his
reasoning in favour of that side: hypothesis for a Jury
does not judge sit alone: and how ever whatever
imperfections that part of the system is liable
to ever receive it may be supposed a correction from the concomitant
authority of the Judge. This accordingly
is Mr Paley's notion: unfortunately all the
expectation of a good decision upon the whole
still rests upon the untenable foundation of a
superior measure of indifferency on the part of the Jury. But let we must let us hear his words:
