The advantage attending the second kind
of judicature is indifference; [we have it has been seen how
far that is from being the case] the defect, the
want of that legal science, which produces uniformity
and justice in legal decisions. I have

what that something is: and given I hope here and there
some ground for inclining joining to the opinion that
the existence of any thing that can pretend to the
name of science is the great scandal a reproach to the system of judicature
and of the laws. The construction of English
courts of law in which causes are tried by a
Jury with the assistance of a Judge, combines
the two species together with admirable peculiar success.
This admirable contrivance unites the wisdom
of a fixed with the integrity of a casual judicature,
and avoids, in a great measure the
