— checking is no province of the Jury
What have the Jury to do with checking? They
are not  ; they are agents and sole
agents. Would not any a stranger he suppose from this
that it was the Judge who gave
the verdict, and that the province of the the Jury was to put a negative
upon it or alter it if they pleased?
The case truth is that the Judge by the influence
of his opinion in the Court which has the power
of granting a new trial may may in some
cases do something towards checking the power of
the Jury. — The Jury check partialities in the
Judge? The fact is that whatsoever is ever done in the
way of checking partialities is done by the admonition, which in the course of his charge may
be given, and not infrequently are given by
