Indifferency is an advantage which in one
word and in that very word has been attributed
by a respectable authority to the "casual" judicature of
a jury in contradistinction to the "fixed' judicature
of a professional judge. or of With
II Paley 260 & 240 8<hi rend='superscript'>vo</hi> what degree of truth may be judged in some
measure from what has been said already. Yet
in the next page but one, + + the candour of the same intelligent author has furnished us with a long list is given
of cases in causes by which this indifference is liable
to be changed, converted and is in practice most notoriously
converted into gross unrestrained and
unrestrainable partiality: and to secure any very few of
them is the probity of the Judge exposed in
any degree, to these in a degree nearly
at all approaching: and these the cases in
ib. 242 which they apply though the list as we have seen
comprise fill up occupy no small
proportion of the field of judicature.
The mos more closely we look into this supposed
advantage, the more better we shall be convinced
