Relative necessity That the decision of a Jury can scarce
have any guidance guide than caprice , I admitt
with sorrow : but where law obstinately abdicates Law is obstinate in ,
and Reason is at too great a distance abdicating , and the voice of Reason is too distant
to be heard , caprice can be the only guide.
Caprice against caprice , there can be no doubt
which to choose , that of the Jury which may
be favourable to liberty , and that of the Judge
which can never be otherwise than hostile to it.
