I have said the As matters stand at present in England this institution, I have said, is
necessary. I have shewn why in its own nature
it is a bad one in its own nature. I have
pointed out its defects: I have shewn them
to be capital radical and incurable: and it is in
full view of these defects that without hesitation under the reasons just mentioned
I pronounce it at present necessary. Why is it now
necessary? because it is so bad a mode of
judicature. ? how and to what end for what purpose is it necessary?
to palliate as a <add>feeble palliative </add> in some sort to the defects
in the state of legislation: to destroy laws which
to enervate law without this check which would destroy society: to
strike the sword out of hands which would
want nothing but the removal of this too feeble defence
to give liberty its death; wound: in
a word to repeal in effect that the laws that have
been made by Judges.
