let it be the least, evil. But I observe how
small what the magnitude of the evil is in
itself is altogether out of the question: the question
as to the proportion of it in the cases of
a Judge such as Jenpion and Jarves according
to the present system. Mark then the difference.
In the one case, At the expence of one man's perjury,
the liberty is preserved, and the business
done: in the other, perjurers succeed to perjurers
by dozens and the business liberty still bleeds at
every pore.
As to any consequences the mischiefs that may come from
this conflict betwixt the body of the people in
one part of the empire and the legislature of
the whole these are not to be placed to the account
altogether out of the question: they are the
same on both sides: as I have shewn over and over again and it is only at the expence
of this mischief evil, and by the very means of this evil that
the power of Juries can be of any use.
