Not that even at the expence of all this a mischief mischief
liberty would purchase any the thus extreme the most perfect innocence or most transcendent
merit in this line of literature and public service could ever purchase
any thing like an effectual prosecution protection. No
man ever yet employ'd his fees upon a political
subject laboured in the service of mankind
in this line whom if his but moderately endowed with circumstances were
but moderate, the gifts of fortune it was not in the power of the servants
of the Crown in all cases, and in
many cases of any individual who had a certain
sum to spare, to consign to ruin in despite
of Juries: for in prosecutions of this kind class the heaviest part of the suffering is not the force or conviction but the expences burthen of defence: not the punishment not that which
is appropriated to guilt or pretended guilt,
but that which is inflicted indiscriminately upon
guilt or and innocence. The privilidge privilege
of doing injury to every individual without making
amends to every any being among the prerogatives
of the crown, neither the Crown nor
its law-servants pay costs in any case: and
costs in such a case, every penny of them is a tribute imposed by them most perfectly oppression, if altogether unnecessary to the ends of justice are rather above beyond than below
the average outgo expenditure of a British subject
during the average continuance of a man's life.
