There is no law properly so called, no passage
in any Statute that gives any definition of a
libel.
There is no such thing as any definition
of a libel to be met with in any judicial decision, or
in any passage of any book which has been recognized by any
decision to be law
There is No definition of a libel can be
collected from the tenor of the decisions on prosecutions
for libels, unless it be such an one as
is altogether incompatible with the right of giving
any opinion of approbation or disapprobation of
the conduct of men in power, and to the people's right in quality of constituents of collecting
grounds for their conduct in the choice of their
representations.
Either therefore there is no law at all in
matters of libel or there is such a law as the
is altogether repugnant to that part of the constitution
the legal existence of what ever portion of political liberty the nation has ever is or ever has been de facto been possessed of.
